This Terms of Use Agreement ("Agreement") governs your use of the website, sign-up form, email communications, and text messaging (SMS) program (collectively, the "Services") provided by the Plemons Eakle Neighborhood Association, a registered 501(c)(3) nonprofit organization ("the Association," "we," "us," or "our").
This Agreement should be read together with our [Privacy Policy], which explains how we collect and use your information, including for our SMS program.

By accessing our website or submitting our sign-up form, you agree to be bound by this Agreement. If you do not agree to these terms, please do not use the Services.

You agree to use the Services only for lawful purposes. When interacting with our Services, you agree not to:
- Violate any applicable law or regulation
- Send unsolicited advertising, spam, or unauthorized promotional material through our Services
- Impersonate another person or misrepresent your affiliation with the Association
- Interfere with or disrupt the proper functioning of our website, form, or messaging program
- Attempt to gain unauthorized access to our systems, contact lists, or accounts
- Use automated tools (bots, scrapers, crawlers) to collect data from our website
- Harvest or collect information about other residents who sign up without their consent
- Upload or transmit viruses or other harmful code through the Services

## 5. Text Messaging (SMS) Program
If you opt in to receive text messages from the Plemons Eakle Neighborhood Association by submitting our sign-up form:
- **What you'll receive:** Neighborhood updates, event announcements, alerts, and related community communications. We do not send promotional or commercial offers.
- **Message frequency:** Varies; approximately 2–6 messages per month.
- **Cost:** Message and data rates may apply. Contact your wireless carrier with questions about your plan.
- **Opt-out:** Text **STOP** at any time to unsubscribe. You will receive one confirmation message, after which you will no longer receive texts from us. You may re-subscribe at any time by submitting the sign-up form again.
- **Help:** Text **HELP** for assistance, or email us at plemonseakle@gmail.com.
- **Carrier liability:** Carriers are not liable for delayed or undelivered messages.
- **Privacy:** Please see our Privacy Policy for information about how we handle your phone number and messaging data. We do not sell or share this information with third parties for marketing purposes.

6. No Purchases or Fees
The Association does not sell products or services through these Services, and there are no purchases, subscriptions, or fees associated with signing up for our communications.

7. Intellectual Property
Content on our website and in our communications (including text, graphics, and logos) is owned by or licensed to the Association. You may view and share this content for personal, non-commercial purposes related to neighborhood community engagement, but you may not reproduce, modify, or use it for commercial purposes without our permission.

If you submit information to us (such as through our sign-up form, email, or by replying to a text), you confirm that the information is accurate and that you have the right to share it. 10. Limitation of Liability
To the fullest extent permitted by law, the Association, its board members, and volunteers are not liable for any damages arising from your use of, or inability to use, the Services, including any missed communications, service interruptions, or reliance on information shared through the Services.

11. Termination
We may suspend or discontinue your access to our communications (including removing you from our contact list) at any time, particularly if you violate this Agreement. You may unsubscribe from any communication at any time as described in Section 5 or by emailing us.

12. Governing Law
This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from this Agreement shall be resolved in a state or federal court located in Potter County, Texas.

13. Miscellaneous
**Severability:** If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full effect.
**Entire Agreement:** This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and the Association regarding your use of the Services.
**No Waiver:** Our failure to enforce any right or provision of this Agreement will not be considered a waiver of that right or provision.
